Terms of Service

1. Acceptance of These Terms
These Terms of Service (“Terms”) form a legally binding agreement between you and Inevara Pty Ltd (ABN [TBD — confirm with Inevara Pty Ltd before public launch]) (“Inevara”, “we”, “us”, or “our”) governing your use of the HEARTHSTONE platform and associated services (collectively, the “Platform”).
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you must not create an account or use the Platform.
2. Eligibility
You must be at least 18 years of age to create an account or use the Platform. By agreeing to these Terms you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract.
If you are using the Platform on behalf of a business entity, you represent and warrant that you have authority to bind that entity to these Terms.
3. Description of the Platform
3.1 What HEARTHSTONE is
HEARTHSTONE is an online home maintenance marketplace. We connect homeowners with verified, licensed local tradespeople and home maintenance professionals (“Providers”) including handymen, pest control technicians, pool care specialists, home inspectors, gutter cleaners, pressure washers, appliance repairers, and chimney sweeps.
HEARTHSTONE uses AI-powered matching technology to surface Providers best suited to a homeowner's property type, location, and maintenance needs.
3.2 What HEARTHSTONE is not
Inevara is a technology platform operator, not a provider of home maintenance services. All services are performed by independent Providers who are separate legal entities from Inevara. We do not employ Providers and do not direct or control how they perform their services.
Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between Inevara and any Provider.
3.3 Platform availability
We aim to operate the Platform continuously but do not guarantee uninterrupted availability. We may temporarily suspend access for maintenance or due to circumstances beyond our control.
4. User Accounts
4.1 Registration
To access most Platform features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you become aware of any unauthorised use of your account.
4.3 Account suspension and termination
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent or harmful conduct, or if required to do so by law. You may close your account at any time by going to Settings → Account → Delete Account.
5. Bookings and Cancellations
5.1 Making a booking
Homeowners may request bookings with Providers through the Platform. A booking is confirmed when the Provider accepts the request and a successful payment authorisation is obtained. By making a booking, you enter into a direct service agreement with the relevant Provider. Inevara is not a party to that service agreement.
5.2 Cancellations
Cancellation and rescheduling policies are set by individual Providers and are displayed on their profile before you confirm. Cancellation fees (if applicable) are charged in accordance with the Provider's stated policy.
If a Provider cancels a confirmed booking, the homeowner will receive a full refund of any amounts charged for that booking.
5.3 Disputes about service quality
If you have a complaint about the quality of a maintenance service, your primary recourse is against the Provider directly. Contact us at [email protected] if you require assistance with mediation, though we are not obliged to do so and are not a party to the underlying service agreement.
6. Payments and Refunds
6.1 Payment processing
Payments on the Platform are processed by third-party payment service providers including Stripe and/or Paddle. All prices are in Australian Dollars (AUD) unless otherwise stated. Applicable taxes (including GST) will be displayed before you confirm payment.
6.2 Refunds
Refunds for cancelled bookings will be processed in accordance with the relevant Provider's cancellation policy. Where a Provider cancels a confirmed booking, a full refund will be issued within 5 business days.
Nothing in this Section limits any rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
7. Provider-Specific Terms
The following additional terms apply to home maintenance professionals who register as Providers on the Platform:
- You must hold all licences, certifications, and insurance required by law for the services you offer (including, where applicable, a QBCC builder's licence, pest management licence, or equivalent state/territory requirement).
- You are solely responsible for accurately describing your services, pricing, service areas, and availability on your profile.
- You must not accept bookings you cannot fulfil and must update your availability promptly.
- You are responsible for complying with all applicable tax obligations on income earned through the Platform.
- You must not solicit homeowners to transact outside the Platform to avoid Platform fees within 12 months of a first introduction facilitated through HEARTHSTONE.
8. Prohibited Conduct
You must not use the Platform to:
- Violate any applicable law, regulation, or court order
- Engage in fraud, misrepresentation, or deception
- Harass, abuse, threaten, or intimidate any other user
- Infringe the intellectual property rights or privacy rights of any person
- Use automated tools, bots, or scrapers to access the Platform without our prior written consent
- Interfere with or disrupt the Platform or its infrastructure
- Create multiple accounts or create an account after yours has been terminated
9. Intellectual Property
The Platform, including its software, design, trade marks, and all content created by Inevara, is owned by or licenced to Inevara. “HEARTHSTONE” and associated logos are trade marks of Inevara Pty Ltd. You must not use our trade marks without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose.
10. Disclaimers
To the maximum extent permitted by law, the Platform is provided “as is” without warranties of any kind. We do not warrant that the Platform will be uninterrupted or error-free. We do not make any representation or warranty about the quality, safety, reliability, or credentials of any Provider. We encourage homeowners to conduct their own due diligence before booking.
11. Limitation of Liability
Nothing in these Terms limits or excludes any guarantee, warranty, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable Australian law.
To the maximum extent permitted by law, Inevara's liability to you for any claim is limited to the amount you paid to Inevara in the 12 months preceding the claim. Because Inevara is a marketplace platform and not a provider of home maintenance services, Inevara is not responsible for the acts or omissions of Providers.
12. Privacy
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. When we make a material change, we will notify you by email and/or by displaying a prominent notice on the Platform at least 14 days before the changes take effect. Continued use after that date constitutes your acceptance of the revised Terms.
14. General Provisions
14.1 Governing law and jurisdiction
These Terms are governed by the laws of the State of Queensland, Australia. You and Inevara submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for the resolution of any dispute.
14.2 Entire agreement
These Terms (including the Privacy Policy) constitute the entire agreement between you and Inevara with respect to your use of the Platform.
14.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force.
